USTR Seeks Public Comments on Proposed Modifications and Machinery Exclusion Process

The Office of the United States Trade Representative (USTR) is actively engaging with importers, interested parties, and the public to gather feedback on proposed changes related to China’s Acts,Policies, and Practices Related to Technology Transfer, Intellectual Property, and Innovation. Here are the key details:

Background

On August 24, 2017, the U.S. Trade Representative initiated an investigation into certain acts, policies, and practices of the Government of China concerning technology transfer, intellectual property, and innovation under section 301 of the Trade Act of 1974. This investigation led to actions taken on July 6, 2018, and August 23,2018, which were modified and did not terminate on their four-year anniversary dates. As part of a review process, the U.S. Trade Representative is proposing additional modifications to these actions.

Proposed Modifications

The U.S. Trade Representative is considering the following modifications:

1. Ad Valorem Rates of Duty: The USTR is proposing to add or increase ad valorem rates of duty for certain products of China in strategic sectors. These modifications are directed by the President.

2. Exclusion Process for Machinery Used in Domestic Manufacturing: The USTR is proposing subheadings eligible for an exclusion process. Interested persons may request that specific machinery used in domestic manufacturing be temporarily excluded from the tariffs.

3. Temporary Exclusions for Solar Manufacturing Equipment: Additionally, the U.S. Trade Representative is granting 19 temporary exclusions for certain solar manufacturing equipment.

            - Deadline for Comments: To ensure consideration, written comments must be submitted by June 28, 2024, at 11:59 p.m. EST.
